He kept touching her inappropriately and using vulgar,\ngraphic and sexist comments about her, she said.<\/em><\/p>\n\n\n\n<p><em>The company looked into her complaint and decided the manager\u2019s actions\nwere just \u201chorseplay\u201d.&nbsp;<\/em><\/p>\n\n\n\n<p><em>A couple of months later, the woman said she was passed over for\npromotion and believed this was because she\u2019d complained about her manager.\n(One of her female colleagues, who\u2019d been harassed by the same manager but had\nnever complained about it, got promoted.)&nbsp;<\/em><\/p>\n\n\n\n<p><em>Shortly after she made this accusation, she was fired.&nbsp;<\/em><\/p>\n\n\n\n<p><em>She sued the firm for sexual harassment and won the case. It cost the company over $600,000 in settlement and defense costs.&nbsp;<\/em><\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Race discrimination<\/strong><\/h2>\n\n\n\n<p><em>A Sudanese laborer had to put up with constant racist comments and jokes\nmade by his co-workers and supervisors. He believed one of his colleagues may\nhave even smashed his car windshield.&nbsp;<\/em><\/p>\n\n\n\n<p><em>He complained to management about the hostile work environment but\nbecause he didn\u2019t see any changes made to correct his co-workers\u2019 behaviour, he\nfelt forced to quit his job.&nbsp;<\/em><\/p>\n\n\n\n<p><em>He filed a suit for constructive termination and the firm was ordered to\npay $3 million by a jury.&nbsp;<\/em><\/p>\n\n\n\n<p>The thing is, a lawsuit doesn\u2019t just drain your financial resources.\nEven if it\u2019s groundless, a claim can disrupt business operations, damage your\nfirm\u2019s reputation and affect employee morale.<\/p>\n\n\n\n<p>Of course, there are steps you can take to reduce the risk of a\njob-related claim.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Get your employment practices right<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Know the law<\/strong><\/h3>\n\n\n\n<p><a href=\"https:\/\/www.dol.gov\/general\/aboutdol\/majorlaws\">Federal law<\/a> protects employees\u2019 rights in all states (unless\nstate employment laws provide a higher level of protection.)<\/p>\n\n\n\n<p>Some federal employment laws only apply when a business reaches a\ncertain number of employees. Title VII, for example, prohibits employers with\n15 or more staff from discriminating by race, religion, sex, color, or national\norigin, when hiring. But there may well be a state law overriding this. So if\nyou\u2019re not sure,<a href=\"https:\/\/www.employmentlawhandbook.com\/state-employment-and-labor-laws\/\"> check<\/a>.<\/p>\n\n\n\n<p>And because employment laws can change at a moment\u2019s notice, as a\nbusiness owner, it\u2019s down to you to keep on top of them.<\/p>\n\n\n\n<p>Make sure your managers do, too. If they\u2019re responsible for hiring, they\nneed to know that seemingly innocent questions like \u2018how old are your\nchildren?\u2019, or \u2018how long do you plan to work until you retire?\u2019, can be seen as\ndiscriminatory. You want to avoid illegal interview questions and interview practices\nthat could lead to a<a href=\"https:\/\/www.eeoc.gov\/\"> U.S. Equal Employment Opportunity Commission (EEOC)<\/a> lawsuit.<\/p>\n\n\n\n<p>And ensure <a href=\"https:\/\/www.insurancebee.com\/blog\/why-train-employees\">your staff get regular training<\/a>.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Right wrongs<\/strong><\/h3>\n\n\n\n<p>Encourage employees to speak up if they feel they\u2019ve been unfairly\ntreated.<\/p>\n\n\n\n<p>Common complaints include:<\/p>\n\n\n\n<p>\u2013 &nbsp; &nbsp; &nbsp; &nbsp; Unfair pay<\/p>\n\n\n\n<p>\u2013 &nbsp; &nbsp; &nbsp; &nbsp; Lack of communication<\/p>\n\n\n\n<p>\u2013 &nbsp; &nbsp; &nbsp; &nbsp; Workload<\/p>\n\n\n\n<p>\u2013 &nbsp; &nbsp; &nbsp; &nbsp; Feeling under-appreciated<\/p>\n\n\n\n<p>\u2013 &nbsp; &nbsp; &nbsp; &nbsp; Discrimination<\/p>\n\n\n\n<p>\u2013 &nbsp; &nbsp; &nbsp; &nbsp; Overbearing managers<\/p>\n\n\n\n<p>A properly drafted <a href=\"https:\/\/www.insurancebee.com\/small-business-risk-guide#KoriAmos\">employment contract<\/a> is invaluable. If an employee claims\nthey\u2019ve been unfairly treated by the firm over something related to the job\nitself, it will determine whether this is the case or not. If there\u2019s a dispute\nthat ends up in a lawsuit, the contract is usually the employer\u2019s first line of\ndefense.<\/p>\n\n\n\n<p>Remember, the sooner you do something to correct a problem, the less\nlikely it is to result in a claim.<\/p>\n\n\n\n<p>If a complaint <em>is<\/em> made, make sure the employee concerned feels\nheard and reassure them that their concerns will be addressed.
