By most states\u2019 statutory law, you\u2019re required to have it if you have employees.<\/p>\n\n\n\n<p>Hiring people without workers\u2019 compensation insurance can bring on all sorts of legal problems \u2013 including severe fines and penalties, or even jail time.<\/p>\n\n\n\n<p>Apart from that, there are lots of practical benefits to having workers\u2019 comp.<\/p>\n\n\n\n<p>It protects your employees if they get sick or injured working for you. It covers their medical fees and lost wages. And it saves you the considerable expense of having to pay for them yourself.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Workers\u2019 comp guidelines for landscaping and lawn care firms<\/strong><\/h2>\n\n\n\n<p>Something we get asked a lot is: what are the workers\u2019 comp guidelines for my landscaping or lawn care company? Do I still need workers\u2019 comp if I&#8217;m the sole proprietor of my business?<\/p>\n\n\n\n<p>Well, first, you should familiarize yourself with <a href=\"https:\/\/www.forbes.com\/advisor\/legal\/workers-comp\/workers-compensation-laws\/\" target=\"_blank\" rel=\"noreferrer noopener\">your own state\u2019s laws and regulations<\/a>. Then consider how you run your business and what insurance you might need.<\/p>\n\n\n\n<p>If you work solely on your own and for yourself then, by law, you might not need workers\u2019 compensation insurance. Although you might want to protect yourself with other types of <a href=\"https:\/\/www.insurancebee.com\/landscaping-insurance\" target=\"_blank\" rel=\"noreferrer noopener\">landscaping<\/a> or <a href=\"https:\/\/www.insurancebee.com\/lawn-care-insurance\" target=\"_blank\" rel=\"noreferrer noopener\">lawn care insurance<\/a>, like <a href=\"https:\/\/www.insurancebee.com\/general-liability-insurance\" target=\"_blank\" rel=\"noreferrer noopener\">general liability<\/a> or tools and equipment coverage. <\/p>\n\n\n\n<p>However, you\u2019ll very likely need workers\u2019 comp if you employ anyone <strong>other<\/strong> than yourself, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Employees (full-time and part-time)<\/li>\n\n\n\n<li>Temporary workers<\/li>\n\n\n\n<li>Self-employed and payroll employees<\/li>\n\n\n\n<li>Volunteers and interns.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Why do landscaping and lawn care companies need workers\u2019 compensation insurance?<\/strong><\/h2>\n\n\n\n<p>Apart from it being a state law requirement, you mean?<\/p>\n\n\n\n<p>If you\u2019re running a busy landscaping or lawn care firm, then you\u2019ve probably got a few projects lined up where you\u2019ll need more than a single pair of hands to get the job done.<\/p>\n\n\n\n<p>That means hiring people to work under your supervision\u2026possibly also using your equipment. Which makes you responsible for their safety and welfare.<\/p>\n\n\n\n<p>Take this scenario:<\/p>\n\n\n\n<p><em>One of your employees complains of a strange ringing in their ears after they\u2019ve spent a good chunk of the afternoon drilling into some concrete. Later, they go to hospital and find out they have tinnitus. The consultant gives them a hearing aid and recommends they take some time off work.<\/em><\/p>\n\n\n\n<p>In this case, the employee <em>could<\/em> claim the ear guards you supplied them with weren&#8217;t fit for purpose and demand compensation. At the very least, they may want reimbursement for their medical treatment and lost wages.<\/p>\n\n\n\n<p>What\u2019s more, if your employee takes you to court and sues you, you can bet your bottom dollar you\u2019ll be left facing some pretty hefty legal bills.<\/p>\n\n\n\n<p>But if you\u2019ve protected your landscaping firm with workers\u2019 compensation insurance, claims like this don\u2019t have to break the bank. <\/p>\n\n\n\n<p>So long as your worker&#8217;s injury&#8217;s covered, your insurance pays out for any court costs and legal fees\u2026as well as medical expenses or compensation owed to your employee.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Do I need workers\u2019 compensation insurance to hire subcontractors?<\/strong><\/h2>\n\n\n\n<p>Before we tackle this, let&#8217;s look at some of the key differences between contractors and sub-contractors (for a more detailed guide by us, see <a href=\"https:\/\/www.insurancebee.com\/blog\/workers-compensation-for-contractors-subcontractors-who-needs-it\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>).<\/p>\n\n\n\n<p>If you\u2019re the owner of a landscaping or lawn care firm, then chances are you\u2019re a <strong>contractor<\/strong>.<\/p>\n\n\n\n<p>That means your client hires you to complete a project for them (often after signing a contract setting out the terms of the arrangement). You\u2019re not on their payroll and you\u2019re still free to take on projects for other clients.<\/p>\n\n\n\n<p>As a contractor, you might also hire a <strong>subcontractor<\/strong> to help you out, especially if specialist skills are needed to finish a particular landscaping or lawn care job.<\/p>\n\n\n\n<p>Subcontractors can operate as individuals or as a company. Either way, they report to <em>you<\/em> and not your client. You supervise their work and pay them once they\u2019ve completed it.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Does working with subcontractors affect my workers\u2019 comp?<\/strong><\/h2>\n\n\n\n<p>Landscaping and lawn care contractors aren\u2019t usually required to carry workers\u2019 compensation insurance for any subcontractors they work with. They might work under your supervision and use your equipment but they\u2019re not generally considered to be your employees.<\/p>\n\n\n\n<p>However, you should double-check the rules with your <a href=\"https:\/\/www.dol.gov\/agencies\/whd\/state\/contacts\" target=\"_blank\" rel=\"noreferrer noopener\">own state\u2019s Department of Labor<\/a>. The legal definition for what an \u2018employee\u2019 is can vary and the penalties for getting it wrong are severe.<\/p>\n\n\n\n<p>Also, some states might require you to carry workers\u2019 comp even if your subcontractors already have their own policy. So, it\u2019s always best to check.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>How else is workers\u2019 compensation insurance good for landscapers?<\/strong><\/h2>\n\n\n\n<p>Don\u2019t forget, your workers\u2019 comp policy is there to protect <em>you<\/em> too.<\/p>\n\n\n\n<p>Because you\u2019re off their payroll, your client\u2019s not obliged cover your medical expenses if you hurt yourself on their property. They might even insist you show them a certificate of insurance before you start working for them, to cover their own back.<\/p>\n\n\n\n<p>The same applies if you\u2019re a landscaping or lawn care subcontractor. To protect themselves, the contractor who hired you might insist on you having your own workers\u2019 comp policy.<\/p>\n\n\n\n<p>Remember, workers\u2019 compensation covers you for the exact same things as it would your own employees. It means that if you get sick or injured and have to fork out for medical treatment or cancel a load of projects, your income won\u2019t suffer.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Risk management tips for landscaping and lawn care companies<\/strong><\/h2>\n\n\n\n<p>Lastly, even though workers\u2019 compensation insurance is crucial when hiring new employees, you should also have certain safety procedures set up to protect them.
